Terms of Service

You must be at least 18 years old to use the Service.

The Service is available only to adults who can form a binding agreement with Clear Health LLC.

Finbird is a personal finance platform that helps users:

• Track spending and income.
• Monitor financial activity.
• Categorize transactions.
• Identify spending patterns.
• Set and monitor savings goals.
• Receive financial insights and recommendations.

Finbird is intended for informational and educational purposes only.

Finbird is not a bank, financial advisor, investment advisor, broker-dealer, tax advisor, accountant, or lender.

The information, insights, recommendations, and suggestions provided through the Service are informational only and should not be considered financial advice, investment advice, tax advice, legal advice, credit advice, or lending recommendations.

You may choose to connect financial accounts through third-party providers such as Plaid.

By connecting an account, you authorize Finbird and its service providers to access and process financial information necessary to provide the Service. Finbird does not store your banking credentials.

Your use of third-party services is subject to the terms and privacy policies of those providers.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities occurring under your account.
• Providing accurate information.

You agree to notify us immediately of any unauthorized use of your account.

Certain features require a paid subscription. Finbird currently offers:

• Monthly Subscription: $4.99 per month.
• Annual Subscription: $49.99 per year.
• 7-Day Free Trial, where offered.

Prices may change in the future. Any changes will apply prospectively.

Subscriptions purchased through Apple’s App Store are processed by Apple.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You may manage or cancel subscriptions through your Apple ID account settings.
• Refund requests are handled by Apple according to Apple’s policies.
• Finbird does not directly process or store payment card information for App Store purchases.

You retain ownership of information you provide through the Service.

You grant Finbird a limited license to use, process, store, and display such information solely for providing and improving the Service.

You agree not to:

• Violate any applicable law.
• Attempt unauthorized access to the Service.
• Reverse engineer the Service.
• Interfere with platform security.
• Use automated systems to access the Service without permission.
• Misrepresent your identity.

Financial data may contain delays, omissions, interruptions, inaccuracies, or errors originating from financial institutions or third-party providers.

Finbird does not guarantee the completeness, accuracy, or availability of any financial information displayed through the Service. You should independently verify important financial information.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR HEALTH LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, the Service will be error-free, financial data will always be accurate, insights will be correct or beneficial, or goals will be achieved.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR HEALTH LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR FINANCIAL LOSSES, LOST PROFITS, MISSED PAYMENTS, INVESTMENT LOSSES, TAX CONSEQUENCES, CREDIT IMPACTS, LOST DATA, INDIRECT DAMAGES, INCIDENTAL DAMAGES, OR CONSEQUENTIAL DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) $100; OR (B) THE AMOUNT YOU PAID TO FINBIRD DURING THE PRECEDING TWELVE MONTHS.

You agree to indemnify and hold harmless Clear Health LLC from claims, damages, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your violation of applicable law.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis.

You waive any right to participate in a class action lawsuit or class-wide arbitration. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.

YOU WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

We may suspend or terminate access to the Service at any time if:

• You violate these Terms.
• We reasonably believe your use poses risk to the Service.
• Required by law.

You may stop using the Service at any time.

We may update these Terms periodically. If material changes are made, we will provide notice through the Service or by other reasonable means.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to conflict of law principles.
